Copyright Protection

REFERENCE
GUIDE

Copyright is often thought of as a protection given to “creative” individuals (authors, musicians, photographers, artists, etc.), but exclusive rights provided under copyright law can have tremendous value for businesses across nearly all industries.

Copyright Prosecution & Counseling

By crafting both a short-term and long-term strategy, our attorneys assist their clients to maximize the true value of their copyrightable work, including computer software, photographs, architectural designs, literature, sculptures, sound recordings, or other works of authorship. At Klemchuk Kubasta LLP, we are experienced in securing, retaining, and enforcing clients’ exclusive rights in their copyrighted works, as well as with preparing and prosecuting copyright applications for a variety of genres to ensure copyright protection.

Although copyright registration usually is only a legal formality to make a public record of the nature of the copyrighted work, federal registration for works of U.S. origin is necessary to file a lawsuit in court against copyright infringement. Copyright prosecution and the ability to recover statutory damages and attorney fees depends on the timing of registration. Registration also allows the owner of a copyright to record the work with the U.S. Customs Service in order to protect against the importation or exportation of potentially infringing copies.
