A federal trademark registration provides added benefits to the owner of the mark.  Registering a trademark gives the owner the exclusive right to use the mark nationwide in connection with the goods or services listed in the registration.  A US trademark registration can also be used as a basis to obtain registration in foreign countries.  Trademark registration puts others on notice that the trademarks are already in use and is therefore a preventative measure against infringers.
 
A federal trademark registration gives constructive notice to the public of the registrant’s claim of ownership of the mark, as well as a legal presumption of ownership.  Furthermore, a trademark registration also gives the registrant the ability to bring an action concerning the mark in federal court.  Once the mark is registered with the United States Patent and Trademark Office, the mark owner is able to use the ® symbol in connection with the mark to alert others of its federal registration.
 
Trademark registration can also help a company guard against counterfeiters.  By filing the trademark registration with the U.S. Customs Service, the mark owner can educate the customs officials about the brand and prevent counterfeits from making their way into the country.
