Username squatting is related to domain name squatting and has become more and more prevalent as social networking sites have gained popularity.  Username squatting involves registering a username, which can be someone else’s domain name, trademark, or company name to cause confusion among consumers or to profit from a future sale of the username back to the trademark owner.  

Keywords and Google^TM AdWords^TM

One of the most prominent online advertising systems is GoogleTM AdWordsTM.  This is a pay-per-click (PPC) advertising system that uses keyword-targeted and placement-targeted priority algorithms.  Many times third parties will use a competitor’s trademark as part of their keyword advertising to attract potential consumers to their sites.  Courts have ruled that, under certain circumstances, a competitor’s trademark appearing in the text of the sponsored advertising may constitute trademark infringement.  Our attorneys have experience litigating cases involving trademark use as meta tags and keywords.
